A safiyar yau ne kotun shari’ar Muslunci dake zaman ta a kofar kudu cikin birnin Kano ta cigaba da sauraren Shari’ar malamin addinin Muslunci Sheikh Abduljabbar Kabara.

Malamin cikin amsoshin sa, ya nanata cewa shi yayi karatu a dukkan fununu na musulunci wajen Mahaifin sa Sheikh Muhammadul Mukhtar Nasir Kabara, kuma ya samu sahhalewar mahaifin sa ta hawa kujerar sa ta gudanar da wa’azi a ko ina a fadin duniya. Ya kuma kara da cewa ya samu shedar karatu daga manyan Malamai na duniya ciki har da wacca Sarkin Morocco Muhammadus Sadis ya bashi, wanda a cewar Malamin tana gaba da kwalin degree.

A karshe Lawya mai gabatar da ƙara ya rufe tambayoyin sa da cewa;
“Ga dukkan masu bibiyar karatun ka na Jauful Fara, abu ne sananne cewa ra’ayin ka shine wannan Alqur’anin da muke amfani da shi “Arrasmul Usmaniy” bai cika ba, shin kana so a cigaba da kallon ka a wannan ra’ayi ko ka sauka daga kai” inji Barista Abdulrahman.

Lawyan dake kare wanda ake ƙara yayi suka akan wannan tambaya inda ya ke ganin cewa bata da alaƙa da shedar da aka bayar, kuma zata kara jan Shari’ar ne da bata lokacin kotu, a lokaci guda kuma ta kara tada tarzoma a waje.

Bayan doguwar muhawara tsakanin lawyoyin duka ɓangarorin, mai Shari’a Alƙali Ibrahim Sarki Yola ya amince Malam Abduljabbar Kabara ya amsa tambayar, duba da cewa akwai alaka tsakanin tambayar da abinda wanda ake ƙara yayi a kotu na rantsuwa da Alqur’ani.

A wannan gaɓa ne masu gabatar da ƙara suka nemi a ɗaga Shari’ar zuwa wata rana dan cigaba da tambayoyin su, inda lawyan wanda ake ƙara Barista Dalhatu Shehu Usman ya ce ya amince amma yana da roƙo a kotu.

“Na amince a ɗaga Shari’ar, amma ina da roƙo. Roƙo na shine dogaro da sashi na 390 (2) ACJL, ina rokon kotu ta sallami wanda ake kara domin tuhumar da ake masa ba ingantacciya bace, ga dalilai na akan haka;

“Tuhumar da ake masa anan tuhuma ce da ake yin ta a ƙarƙashin sashe na 382 (b) na kundin shari’ar laifuffuka ba, roko na ya samo asali ne yau bisa ga tambayoyin da masu gabatar da kara sukayi da kuma cajin da ke gaban kotu. ”

“Sashen da ake tuhumar wanda ake ƙara na 382 (b) Shari’a penal code Yana magana ne akan wanda yayi kalaman ɓatanci ga Annabi Muhammad Sallallahu alaihi Wa Alihi Wasallam, idan aka bi cajin nasu za a ga suna tuhumar ne akan an yi ɓatanci ga Bukhari da Muslim amma ba ga Annabi Muhammad ba.” Inji Barista Dalhatu.

Bayan gama gabatar da hujjojin sa, Lawyan masu gabatar da kara yayi suka inda ya ce wannan roƙo da Lawyan wanda ake ƙara yayi bai da muhalli a doka, dole sai an kammala da shedu sannan za a iya tabbatarwa ko kore tuhuma.

Lawyan wanda ake ƙara ya sake martani inda yace shi sukar sa yayi ne da kundin tsarin mulkin ƙasar Najeriya, kuma abinda ya fada din shine dai a rubuce a doka, haka kuma shine a tuhumar da suka rubuto zuwa kotu.

A karshe mai Shari’a Alƙali Ibrahim Sarki Yola ya dage zaman Shari’ar zuwa ranar 7/7/22 don jin ra’ayin sa akan wannan roƙo sannan a cigaba da gudanar da tambayoyi ga Malamin.
